Terms of Service

These Terms of Service (hereinafter "ToS") govern access to and use of the TAPLY platform accessible at taply.so (hereinafter "the Platform"), published by TAPLY (hereinafter "we", "our" or "TAPLY").

By accessing the Platform or creating an account, you accept these ToS without reservation. If you do not accept these terms, please do not use the Platform.

1. Definitions

  • User: any natural or legal person who creates an account and uses the Platform.
  • Workspace: a work area created by a User to manage their links, QR codes, physical products and leads.
  • Link: a shortened URL or landing page created via the Platform (redirect, landing page, roulette, A/B test).
  • Physical product: NFC plaque, NFC card, NFC sticker, or any other physical medium sold by TAPLY.
  • QR Code: a dynamic QR code generated via the Platform and linked to a Link.
  • Lead: a contact collected via a form on a landing page or roulette.
  • Subscription: enrollment in a paid plan offering extended features.

2. Registration and Account

2.1 Account Creation

To use the Platform, you must create an account by providing a valid email address and a password, or by signing in through a third-party service (Google). You warrant that the information provided is accurate, complete and up to date.

2.2 Account Security

You are responsible for the confidentiality of your login credentials and all activities conducted under your account. In case of unauthorized use of your account, you must immediately notify us at hello@taply.so.

2.3 Minimum Age

You must be at least 16 years old to create an account. If you are a minor, you must obtain the authorization of your legal representative.

3. Description of Services

3.1 Free Plan

TAPLY offers a free plan allowing you to:

  • Create and manage shortened links and landing pages
  • Generate dynamic QR codes
  • Collect leads via forms
  • Access basic statistics (clicks, scans)

3.2 Paid Plans

Paid plans (Pro, Business, etc.) offer additional features such as:

  • Unlimited links and QR codes
  • Custom domains
  • Advanced analytics
  • Team members
  • TAPLY branding removal
  • Priority support

Feature details and pricing are available on the Pricing page. TAPLY reserves the right to modify its pricing with 30 days' notice.

3.3 Physical Products

TAPLY sells NFC physical products (plaques, cards, stickers, etc.) allowing users to share a link via NFC technology. Specific sales conditions are detailed in the General Terms of Sale.

4. Acceptable Use

4.1 Permitted Uses

The Platform is intended for legal professional and personal use. You may:

  • Create links to your website, social media, portfolio or any legal content
  • Collect leads with the consent of the data subjects
  • Use QR codes and NFC products to redirect to your content
  • Invite team members to your workspace

4.2 Prohibited Uses

It is strictly prohibited to use the Platform to:

  • Distribute illegal, fraudulent, defamatory, hateful, violent or pornographic content
  • Engage in phishing, identity theft or any form of fraud
  • Distribute malware, viruses or any harmful code
  • Send spam or unsolicited communications
  • Collect personal data without consent (GDPR violation)
  • Infringe third-party intellectual property rights
  • Intentionally overload servers or attempt unauthorized access to systems
  • Use bots or automated scripts to create accounts or links in bulk
  • Resell access to the Platform without authorization

4.3 Consequences of Violations

In case of violation of these ToS, TAPLY reserves the right to:

  • Suspend or delete your account without notice
  • Disable the offending links, QR codes or pages
  • Remove the infringing content
  • Report illegal activities to the competent authorities

5. Intellectual Property

5.1 TAPLY's Property

The Platform, its source code, design, features, texts, images and logos are the exclusive property of TAPLY and are protected by intellectual property law. No license is granted to the User on these elements, other than the right to use the Platform in accordance with these ToS.

5.2 User Content

You retain ownership of all content you publish on the Platform (texts, images, logos on your landing pages, etc.). By publishing content, you grant TAPLY a non-exclusive, worldwide, royalty-free license to host, display and distribute this content for the purpose of providing the service.

You warrant that you have the necessary rights to the content you publish and that it does not infringe any third-party rights.

6. Personal Data and Privacy

TAPLY collects and processes personal data in accordance with GDPR and the French Data Protection Act. Details of the processing are described in our Privacy Policy.

As a user collecting leads via the Platform, you are responsible for the processing of your own users' data and must comply with GDPR (consent, information, right of access, right to erasure, etc.).

7. Payment and Billing

7.1 Pricing

Subscription and physical product prices are displayed in euros (EUR), inclusive of all taxes (TTC) for individuals, and exclusive of taxes (HT) for professionals where applicable.

7.2 Payment

Payments are processed securely by our payment provider Stripe. TAPLY does not have access to your complete bank information. Accepted payment methods include credit cards (Visa, Mastercard, American Express).

7.3 Automatic Renewal

Subscriptions are automatically renewed at the end of each billing period (monthly or annual). You will be notified by email before each renewal. You can cancel automatic renewal at any time from your dashboard.

7.4 Late or Failed Payment

In case of payment failure, TAPLY reserves the right to suspend access to paid features until the situation is resolved. A reminder email will be sent before any suspension.

8. Service Availability

TAPLY strives to keep the Platform accessible 24 hours a day, 7 days a week. However, TAPLY does not guarantee permanent availability and cannot be held liable in case of:

  • Maintenance interruptions (planned or emergency)
  • Technical failures of servers or infrastructure
  • Force majeure (natural disaster, widespread network failure, etc.)
  • Malicious acts by third parties (DDoS attacks, hacking)

In case of planned maintenance resulting in a prolonged interruption, users will be notified by email within a reasonable timeframe.

9. Limitation of Liability

The Platform is provided "as is". TAPLY does not guarantee that the Platform will meet all your specific needs or that its use will be error-free.

TAPLY shall in no case be held liable for indirect damages, including but not limited to: loss of revenue, data loss, loss of customers, damage to reputation, commercial harm, resulting from the use or inability to use the Platform.

TAPLY's total liability under these ToS shall not exceed the amounts paid by the User during the 12 months preceding the event giving rise to liability.

10. Termination

10.1 By the User

You can delete your account at any time from your account settings or by sending an email to hello@taply.so. Account deletion results in:

  • Cancellation of any active subscription (without prorated refund)
  • Deactivation of all your links, QR codes and pages
  • Deletion of your data within 30 days (except where legal retention obligations apply)

10.2 By TAPLY

TAPLY reserves the right to terminate your account in case of violation of these ToS, fraudulent use or prolonged inactivity (more than 24 months without login). A 15-day notice email will be sent before any deletion for inactivity.

11. Changes to ToS

TAPLY reserves the right to modify these ToS at any time. Changes will take effect upon their publication on the Platform. In case of a substantial modification, Users will be notified by email at least 15 days before the new terms take effect.

Continued use of the Platform after modification of the ToS constitutes acceptance of the new terms.

12. Governing Law and Disputes

These ToS are governed by French law. In case of a dispute regarding the interpretation or execution of these ToS, the parties agree to seek an amicable solution before any legal action.

In accordance with the provisions of the French Consumer Code regarding amicable dispute resolution, you may use the mediation service offered by: [TO BE COMPLETED — consumer mediator].

Failing amicable resolution, the dispute shall be submitted to the competent courts of the jurisdiction of TAPLY's registered office.
